Loable actitud del regulador chileno, encargado de aplicar la neutralidad de red y sancionar su incumplimiento, al prevenir ofertas comerciales de empresas de telefonía móvil tendiendo a privilegiar el dominio de redes sociales establecidas a través de su uso sin cargo. Lo meritorio es no haber impuesto sanciones sino advertir a los posibles infractores sobre su posición en relación a un tema como mínimo controvertido. Esa actitud preventiva requiere de conocimiento, profesionalismo y dedicación honesta a la función pública.

Reporte de ongcivico.org sobre el rol de la Subtel en prevenir prácticas que afectan la neutralidad-en-la-red con motivo de la existencia de oferta de redes-sociales-gratis a través de telefonia movil La Circular 40-2014 de Subtel que en rol preventivo avisa a los operadores de telecomunicaciones móviles acerca de la afectación del principio de neutralidad de red las ofertas que han realizado.

Algunos consideran que la multa de más de 1 millón y medio de dólares impuesta a Oi en Brasil por violar el Marco Civil de Internet es por afectar la neutralidad de red pero considero que la sanción está más relacionada con la afectación del régimen de protección de datos personales.

·          El Marco Civil de Internet, sancionado a principios de año, fue recibido por aquellos que están a favor de la neutralidad de red, como una confirmación de la vigencia con rango legal de dicho principio en América Latina (junto con las leyes ya existentes en Chile y Colombia).  Si bien la ley en su articulado establece claramente que toda transmisión de datos debe ser tratada en forma igualitaria independientemente del contenido, origen, destino, servicio, terminal o aplicación utilizado, delega en el Poder Ejecutivo la forma de ser reglamentada la implementación del referido principio.  Esta ley, antes de su sanción no estuvo libre de controversias, cuando se establecía que los proveedores de servicios en Internet extranjeros que almacenasen datos vinculados a usuarios brasileros debían conservarse en servidores ubicados en Brasil.
